By accessing or utilizing Dainik ("the Service," "we," "us"), located at https://dainik.app and its associated endpoints, you agree to be bound by these Terms of Service. If you do not agree to these terms, you must immediately cease using the Service. These terms apply to all human visitors, automated agents, web crawlers, and API consumers.

2. Description of Service

Dainik acts as a high-performance, real-time data aggregator. We programmatically compile and display public information relevant to Nepal, including but not limited to the Bikram Sambat calendar, NEPSE stock metrics, foreign exchange rates, bullion prices, agricultural commodity rates, weather telemetry, and news headlines. Dainik does not generate this original data and acts solely as an intermediary conduit for public information.

3. Acceptable Use and Automated Access (Crawlers)

We actively welcome both human users and automated agents (such as search engine crawlers and Large Language Models) to index our public data, provided that such access complies with the following conditions:

• Automated access must respect the directives outlined in our /robots.txt file.
• You may not engage in high-frequency scraping that degrades the performance of our infrastructure, constitutes a Denial of Service (DoS), or negatively impacts other users.
• You may not use the Service for any unlawful purpose, or to facilitate the distribution of malware or malicious traffic.

4. User Accounts and Security

If you register for an account to persist your settings, you are responsible for maintaining the confidentiality of your authentication credentials. You agree to notify us immediately of any unauthorized use of your account. We reserve the right to suspend or terminate accounts that violate these Terms or exhibit suspicious, abusive behavior.

5. Intellectual Property Rights

The proprietary architecture, source code, UI/UX design, logos, and specific algorithmic presentation of Dainik are the exclusive intellectual property of Dainik's operators. However, we claim no copyright over the raw, underlying public facts and figures (e.g., NEPSE indices, NRB forex rates, calendar dates) displayed on the site.

You are free to quote, share, and utilize the data presented on Dainik for personal or editorial use. However, systematic, wholesale republication or wrapping of our interface for commercial gain without written authorization is strictly prohibited.

6. Disclaimers and Limitations of Liability

Dainik is provided strictly on an "AS IS" and "AS AVAILABLE" basis.

While we strive for absolute technical precision and synchronization with official statutory sources, we make no explicit warranties regarding the absolute accuracy, completeness, or real-time timeliness of the data presented. Network latency, upstream API failures, and third-party inaccuracies may occasionally result in delayed or incorrect data.

To the maximum extent permitted by applicable law, Dainik, its operators, and its affiliates shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising from your reliance on the data provided. You explicitly agree that you will independently verify all financial, legal, and critical information (such as stock prices, gold rates, and currency exchanges) directly with authorized brokers or statutory authorities before executing any transaction.

7. Third-Party Links and Content

Dainik aggregates headlines and provides external hyperlinks to third-party news publishers and statutory websites. We do not endorse, govern, or assume responsibility for the content, privacy practices, or operational reliability of these external entities.

8. Modifications to the Service and Terms

We reserve the right to modify, suspend, or discontinue any facet of the Service at our sole discretion, without prior notice. We may also revise these Terms of Service periodically. Your continued use of Dainik following the posting of updated Terms constitutes your binding acceptance of those changes.

9. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Nepal. Any legal disputes arising in connection with your use of Dainik shall be subject to the exclusive jurisdiction of the competent courts located in Kathmandu, Nepal.
